Berger Montague served as lead counsel and obtained a settlement of over $1 million for a class of 340 mortgage underwriters based on allegations of unpaid overtime. Led by Shanon J. Carson of Berger Montague, the lawsuit alleged that Zenta Mortgage Services LLC improperly misclassified its mortgage underwriters as exempt from the overtime requirements of the Fair Labor Standards Act, 29 U.S.C. § 201, et seq. (“FLSA”). The lawsuit therefore claimed that Zenta violated the FLSA by failing to pay its mortgage underwriters at time and a half their regular rate of pay for any overtime hours worked over 40 hours per week. The case was litigated in the United States District Court for the Western District of North Carolina and captioned Crawford v. Zenta Mortgage Services LLC, et al., No. 3:11-cv-00129-GCM (W.D.N.C.).

During the litigation, the defendants reclassified the mortgage underwriters to non-exempt status and began paying them at an hourly rate with overtime pay for every hour worked over forty hours per week. The parties thereafter reached a settlement for the class in the amount of $1,012,500.00.
