Berger & Montague played a significant role participating as
Co-Lead and Co-Trial Counsel in this landmark class action on
behalf of nationwide classes of purchasers of corrugated boxes and
sheets from 37 manufacturer/defendants. The litigation
resulted in settlements totaling more than $360 million. One
of the settlements was achieved after a jury trial before District
Judge John Singleton in Houston, Texas where Berger & Montague
served as co-trial counsel on behalf of a corrugated sheet
class. Two defendants settled during trial and a third, the
Mead Corporation, after the jury found it had participated in a
conspiracy in violation of the Sherman Act. See 556 F.
Supp. 1117 (S.D. Tex. 1982). The litigation resulted in several
decisions by the Fifth Circuit Court of Appeals including those
reported at 643 F. 2d 195 (5th Cir. 1981); 659 F.2d 133 (5th Cir.
1981); 752 F.2d 137 and 411 (5th Cir. 1985).
