Berger & Montague is participating as co-counsel in a
lawsuit against Delta Air Lines, Inc. and AirTran Airways, Inc.,
alleging a conspiracy to impose parallel first-bag fees.
Plaintiffs, who paid first-bag fees for travel on Delta or
AirTran flights, allege that the defendants engaged in a
per se illegal price-fixing conspiracy to
implement identical $15 first-bag fees. Both Defendants announced
their new fees in November of 2008, to be effective on the exact
same date (December 5).
About the case:
On February 3, 2012, and again on August 3, 2015, the district
court issued orders imposing sanctions against Delta for failing to
produce relevant documents requested by plaintiffs in this
