Berger & Montague represented a proposed class
of direct purchasers of titanium dioxide, a product used in paints,
inks and other applications.
Plaintiffs alleged that defendants (Huntsman, Kronos
Worldwide, Inc., DuPont and Millennium Inorganic Chemicals, Inc.),
the primary suppliers of titanium dioxide in the U.S., conspired to
raise, maintain or stabilize the prices for the product between
March, 2002 and the present.
On August 14, 2013, Judge Bennett denied defendants'
motions for summary judgment.
On December 13, 2013, the Court granted final approval to
settlements totaling $163.5 million.
