Berger & Montague, P.C., has filed consumer protection class
action lawsuits against Lumber Liquidators Holdings, Inc. and
several of its subsidiaries in the U.S. District Court for the
Northern District of Georgia and U.S. District Court for the
Eastern District of Tennessee. The lawsuits allege that the
company has sold dangerously defective wood laminate flooring
products and engineered wood flooring products produced in China
containing unacceptably high levels of formaldehyde, a known
carcinogen. Lumber Liquidators has manufactured and sold
these laminate and engineered flooring products under the "Dream
Home" brand name.
Lumber Liquidators' "Dream Home" flooring products are
sold with packaging and labels that claim that such products are
compliant with the levels of formaldehyde allowed by the California
Air Resources Board ("CARB"), a standard which is in the process of
being adopted by the Environmental Protection Agency ("EPA") for
the entire United States. Specifically, these labels state:
"California 93120 Phase 2 Compliant Formaldehyde."
However, a report from "60 Minutes" recently revealed that
Lumber Liquidators' Chinese manufactured laminate flooring products
contain glue and resin used to bond the pressed wood together that
can be a significant source of formaldehyde gas, and that these
flooring products are not compliant with CARB standards.
