Law360, New York (September 02, 2011, 6:08 PM ET) -- A California federal judge on Friday tentatively approved a $27.25 million settlement between Wal-Mart Stores Inc. and plaintiffs in an antitrust multidistrict litigation accusing the retailer of conspiring with Netflix Inc. to divvy up the online DVD rental and sales markets.

U.S. District Judge Phyllis J. Hamilton signed off on an order granting preliminary approval to the settlement, which will give Netflix subscribers a choice of either cash or an online gift certificate.

The judge also certified the settlement class, which includes any person in the U.S. or Puerto Rico who paid a subscription fee to rent DVDs from Netflix since May 2005.
