A group of loan officers for Fifth Third Bancorp's Cincinnati-based regional banking corporation lodged a class action Wednesday claiming the bank failed to pay them overtime wages in violation of the Illinois Minimum Wage Law and Wage Payment and Collection Act.

Loan officer Alaina Morerro brought the suit in Illinois federal court, alleging that the bank improperly classified the loan officers as exempt from overtime pay requirements under Illinois state wage laws until about January.

Even after changing the loan officers' status to nonexempt early this year, the bank switched tactics and mandated that its loan officers underreport their time worked to avoid paying overtime, the suit says.

Morerro says the bank should have known its conduct was illegal.
