Block v. McDonald’s Corporation – Consumer Class Action Settlement

Berger Montague served as Co-Lead Counsel and obtained a settlement of $12.5 million with McDonald’s Corporation due to its failure to disclose the use of beef fat in its french fries. Berger Montague, led by Executive Shareholder Sherrie R. Savett and Michael Fantini, reached this important settlement on behalf of a class of persons having ethical, moral, health, and/or religious objections or concerns with respect to the consumption of beef or meat. The lawsuit arose out of McDonald’s misrepresentation that its french fries and hash browns were cooked in 100% vegetable oil, when in fact they contained beef flavoring and were not vegetarian. The plaintiffs alleged that McDonald’s conduct violated state consumer fraud statutes and common law prohibitions against unfair and deceptive business practices.

The settlement included that McDonald’s issue an apology that was published on its website and print publications, as well as the creation of an advisory board to make recommendations to McDonald’s regarding the vegetarian, non-beef, and non-meat eating categories of consumers, and applicable dietary restrictions.
