Berger Montague served as co-lead counsel and obtained a $24 million settlement in this multidistrict litigation lawsuit against Menu Foods and other defendants seeking damages for harms caused by the manufacture and sale of contaminated dog food and cat food. The case was litigated in the United States District Court for the District of New Jersey and captioned In re Pet Food Products Liability Litigation, MDL Docket No. 1850, No. 07-cv-02867 (D.N.J.).

Led by Sherrie R. Savett and Russell Paul of Berger Montague, the consolidated litigation included over 80 class actions that had been filed against more than 60 pet food entities, that were transferred to the New Jersey federal court for MDL proceedings. The plaintiffs and class members alleged that they sustained economic losses as a result of the defendants’ actions, and sought compensation including the cost of purchasing the recalled pet food products, veterinary expenses, and autopsy, necropsy, and burial expenses for their beloved pets. The settlement permitted class members to recover up to one hundred percent of their economic damages without any limitations on the types of economic damages they could recover.
