Settlement Reached in Class Action Lawsuit Against Ford Motor Company

Berger & Montague, P.C. is pleased to announce that on March 27, 2017, a settlement agreement was signed and the preliminary approval papers filed in Omar Vargas v. Ford Motor Company, a nationwide class action lawsuit against Ford Motor Company on behalf of owners and lessees of the 2011-2016 Ford Focus and 2012-2016 Ford Fusion.

The allegations concern the vehicles' defective transmission, called the Ford PowerShift Transmission, which is a dual clutch transmission first released in 2010. Plaintiffs alleged that this transmission was defective and caused vehicles to slip, buck, kick, or jerk while accelerating.

In addition to provisions for cash payments and extended warranties in certain circumstances, the settlement has an expedited arbitration program with an extended statute of limitations period that allows for the automatic repurchase or replacement of class vehicles under certain conditions.

The settlement received final approval on October 18, 2017.
